§ 1 – The Pirate Party.
§ 1.1 – Name, activity and purpose
The “Italian Pirate Party”, breviter “PP-IT.”, whose symbol is the emblem used in electoral competitions, is based in Italy, Rome, Piazza del Viminale n. 5. The transfer of the Association’s registered office, within the same municipality, does not entail any statutory modification.
The Italian Pirate Party engages in political activity in every form and way to achieve the goals designated in the Manifesto and the General Political Motion in force and to promote the fundamental rights of the person as recognised by the Universal Declaration of Human Rights, the other treaties of international law, the Italian Constitution and the European Union. It is a founding member of the European Pirate Party and the International Pirate Party.
§ 1.2 – Rights and obligations of the member
Anyone can join the Italian Pirate Party.
Any discriminatory practise is forbidden.
The registration is individual, valid for a calendar year and is renewed only with the payment of the registration fee.
No one can be prematurely deprived of his membership status.
The members are not bound to any party discipline.
The vote is personal, cannot be delegated, is free and is public.
§ 1.3 – Financing.
Funding to the Italian Pirate Party comes from the annual membership fees and any other contribution freely granted by members and non-members.
§ 2 – The bodies of the Italian Pirate Party.
§ 2.1 – Bodies.
They are statutory organs of the Italian Pirate Party:
- The Congress;
- The Secretary;
- The Treasurer;
- The Guarantor.
§ 2.2 – Congress.
The Congress of the Italian Pirate Party is convened by the Guarantor at least once a year, ordinarily in November, with at least thirty days notice, five days in case of urgency, indicating the title, date, duration and place of the Congress.
The Guarantor is required to convene the Congress of the Italian Pirate Party if requested by the Secretary, with the favourable opinion of the Treasurer, or by at least one-third of the pirates registered for at least six months at the date of the request. The request must indicate the title, date, duration and place of the Congress.
The Congress of the Italian Pirate Party must be organised in such a way as to allow the broadest possible participation by the registered pirates, actively resolving all personal, social and economic situations that prevent the physical presence of the registered pirates. The right to vote must be guaranteed to registered pirates who cannot vote due to illness or physical impossibility.
The meeting is valid whatever the number of registered pirates present.
Decisions are approved by a majority vote of those present.
The audiovisual recording shall constitute minutes of the meeting for all legal purposes.
The Italian Pirate Party Congress is competent:
- the approval of the General Political Motion which, if voted by a qualified majority of 2/3 of those present, is binding for the bodies of the Italian Pirate Party;
- the approval of the amendments and additions to the Manifesto and the Statute and to its own operating regulations;
- the election of the Secretary, Treasurer and Guarantor of the Italian Pirate Party.
At the Congress of the Italian Pirate Party convened for the election of the statutory offices, the Secretary, the Treasurer and the Guarantor of the Italian Pirate Party shall resign and be in the prolongation until the proclamation of the newly elected ones who shall take office immediately. All other bodies, offices and delegates, other than those mentioned above, shall lapse, without any prorogatio imperii, at the opening of the Congress of the Italian Pirate Party convened for the election of the statutory offices.
§ 2.3 – The Secretary
The Secretary is the political and executive leader of all the political activities and initiatives, directly or indirectly, of the Italian Pirate Party. They define all the initiatives they deem appropriate for the achievement of the objectives set by the Congresses voted by qualified majority and determines, after consulting the Treasurer, the allocation of the personal, economic-financial, technological resources available to the initiatives undertaken by the statutory and non-statutory bodies for the achievement of the objectives of the Italian Pirate Party.
The Secretary shall appoint, for the duration of his term of office, all non-statutory bodies of the Italian Pirate Party and may delegate one or more sectors of activity or individual initiatives to members. He has the exclusive charge for the communication of the Italian Pirate Party.
The Secretary is responsible for the availability of the technological infrastructure of the Italian Pirate Party. The Secretary may revoke designations and delegations “ad nutum”.
The office of Secretary is biennial and renewable.
§ 2.4 – The Council
The Council of the Italian Pirate Party is an advisory body to the Secretary and provides him with help and advice.
The Council of the Italian Pirate Party is composed, for the duration of the appointment or delegation, of the pirates appointed or delegated by the Secretary, including non-statutory bodies.
The Secretary, who presides over the Council of the Italian Pirate Party, the Treasurer and the Guarantor shall participate in the Council of the Italian Pirate Party.
The Council of the Italian Pirate Party has no deliberative functions.
§ 2.5 – Treasurer
The Treasurer has the legal representation of the Italian Pirate Party.
The task of the Treasurer is the direct management, total control and full responsibility for the Pirate Party’s income and expenditure of money, including the keeping of accounting records. Specifically, the Treasurer is responsible for the preparation and presentation of annual accounts and budgets, the burden of collecting registration fees and the custody and protection of the Italian Pirate Party’s assets.
The Treasurer may delegate one or more areas of its competence to registered pirates. The Treasurer may revoke the delegations ad nutum.
After consulting the Secretary, the Treasurer shall determine, by November of each year, the amount of the registration fee for the following year.
The office of Treasurer is biennial and renewable.
§ 2.6 – Guarantor
The Guarantor has the role of Guarantor to protect the members of the Italian Pirate Party, manages the registration process, keeps the membership register, receives withdrawal requests and is responsible for the processing of personal data.
The office of Guarantor, for which the possession of a law degree or equivalent is prescribed, is two years and renewable.
§ 3 – Transitional and final rules
§ 3.1 – Entry into force
These Articles of Association shall enter into force immediately upon their approval.
All regulations in force shall be repealed with the exception of the rules for the functioning of the current National Congress.
All offices, both statutory and non-statutory, shall lapse with the exception of the President, who shall assume the powers of the Secretary, the Treasurer and the Guarantor in the prolongation until their renewal in the current National Congress.
§ 3.2 – Dissolution
The Congress, with a motion voted by a qualified majority of 2/3 of the members, may dissolve the Italian Pirate Party. The Secretary, the Treasurer and the Guarantor in office shall act as liquidator. The assets are devolved to the United Nations Educational, Scientific and Cultural Organization (U.N.E.S.C.O.).
§ 3.3 – Reference to the Civil Code
For anything not provided for in these Articles of Association, the provisions of the Italian Civil Code governing non-recognised Associations shall apply.
